Return Policy Terms and Conditions

Please read the following Terms and Conditions as not all products will qualify for return. All Return Material Authorization (RMA) clams are subject to review and will be issued an RMA number if these terms and conditions are met. Anything that does not meet this criterion will be automatically disapproved for return. Click on the link RMA FORM. Save the form to your computer then fill out and submit via email to orders@americanbuiltpro.com. Note: if you cannot save the download as a PDF, please fill out, print, scan and email to orders@americanbuiltpro.com.

1. Acceptance of Terms

By placing an order with American Built Pro (“Supplier”) at americanbuiltpro.com, the buyer (“Buyer”) agrees to these Terms and Conditions of Sale. These Terms govern all purchases of products and services from American Built Pro. These Terms constitute the entire agreement and supersede all prior communications.

2. Order Processing and Lead Times

Orders are generally processed within 48 hours of payment confirmation.
Order processing times are separate from shipping transit times.

3. Price and Payment

All prices are in U.S. dollars and are subject to change without notice until payment is received.
Payment must be received prior to shipment unless Supplier has approved alternate payment terms in writing.
Buyers under a purchase contract must pay invoices by the due date specified on the invoice.

4. Shipping & Delivery

Unless otherwise agreed in writing, all products are sold Free on Board (FOB) Supplier’s facility.
Risk of loss passes to Buyer upon delivery of merchandise to the carrier.
Shipping dates are estimates and not guaranteed. Supplier shall not be liable for delays due to carrier issues, weather, or other causes beyond Supplier’s control.
Buyer must inspect all deliveries immediately upon receipt. Claims for shortages or visible damage must be reported promptly.

5. Taxes and Fees

Buyer is responsible for all unrecoverable applicable taxes, duties, tariffs, and governmental charges.
If Supplier pays any such fees on Buyer’s behalf, Buyer shall reimburse Supplier promptly.

6. Warranty of Title

Supplier warrants that it holds good title to the merchandise sold and that merchandise are free of liens and encumbrances, except for any security interest retained by Supplier for unpaid balances.

7. Inspection & Claims

Buyer must inspect items immediately upon arrival.
Buyer must notify Supplier of any defects, discrepancies, or damages within 1-2 days after delivery.
Failure to provide timely notice constitutes acceptance of the merchandise.

8. Returns & Restocking

Returns are only accepted in accordance with American Built Pro’s published Return Policy.
Approved returns may incur restocking fees as described in the Return Policy and are subject to deductions for shipping and handling costs.
Special order and custom items may not be returnable unless defective upon receipt.

9. Cancellation

Orders may not be canceled once payment is made, except with Supplier’s written consent.
Cancellations may incur a cancellation fee based on costs incurred and profit margin lost.

10. Limitations of Liability

To the maximum extent permitted by law:

Supplier shall not be liable for incidental, special, or consequential damages, including loss of profit or business interruption.
Supplier’s total liability for any claim related to products or services shall not exceed the amount paid by Buyer for the merchandise in question.

11. Warranty Disclaimer

Unless expressly stated in writing, Supplier disclaims all implied warranties, including merchantability and fitness for a particular purpose.

12. Force Majeure

Supplier shall not be liable for delayed performance or non-performance caused by events beyond its control, including but not limited to acts of God, strikes, shortages, or transportation issues.

13. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the state of Georgia where American Built Pro is headquartered.
Any dispute arising from or related to these Terms shall be resolved in courts located in that state.
Buyer consents to the exclusive jurisdiction of such courts.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect.

15. Modification

American Built Pro reserves the right to revise these Terms at any time. Continued ordering constitutes acceptance of updated Terms.

16. Refusal of Service

Supplier reserves the right to refuse service to any Buyer at its discretion.
